Victoria’s Secret Sues Over KnockOffs

The company says its fragrances are being copied.

Victoria’s Secret and its affiliate Bath & Body Works are suing a Brooklyn-based company over trademark infringement.

The companies said in a lawsuit filed on Feb. 6 in Ohio, that Preferred Fragrance and its one-time CEO Izriel Polatsek sold knockoffs of VS fragrances. The brands include Vanilla Lace, Coconut Passion, Mango Temptation and Love Spell.

Preferred Fragrance has been sued before – last year, the company sold “Party Candy,” which Prada said was a knockoff of Prada Candy – in nearly identical packaging.

The complaint claims that the trade dress of the Victoria’s Secret Fantasies fragrance, Vanilla Lace, (shown on left) has been violated. This includes the fragrance’s wide-shouldered mist bottle, the crest design incorporating the product name and the ribbon element on the bottle.

VS / Limited Brands also claims that its Bath & Body Works fragrance, Pink Chiffon (shown on right), in its Signature collection, has been infringed upon – specifically the tall, narrow, clear cylindrical bottle wrapped in a light-pink sheer label.
